Waste Collection Bermondsey Service Terms and Conditions

These Terms and Conditions set out the basis on which waste collection services are provided by Waste Collection Bermondsey to residential and commercial customers. By booking a waste collection, arranging a regular service, or allowing our operatives to collect waste from your premises, you agree to be bound by these Terms and Conditions.

If you do not agree with any part of these Terms and Conditions, you should not use our waste collection services. You are encouraged to read this document carefully before placing a booking.

Definitions

In these Terms and Conditions, the following definitions apply:

Company refers to Waste Collection Bermondsey, the provider of the waste collection services.

Customer refers to the person or organisation booking or receiving the services.

Services refers to waste and rubbish collection, removal, transportation and related services provided by the Company.

Premises refers to the address at which the Services are to be performed.

Waste refers to items and materials presented by the Customer for collection, excluding any prohibited or hazardous items noted in these Terms and Conditions.

Scope of Services

The Company provides waste collection services for household waste, bulky items, commercial waste and recyclable materials, as agreed at the time of booking. The exact scope of the Services, including the type and estimated volume of waste, collection date, time window and price, will be confirmed during the booking process.

The Company reserves the right to decline any booking where the waste type, volume, access conditions or other factors mean the job cannot be safely or lawfully carried out, or falls outside the normal scope of operations for the Bermondsey waste collection area.

Booking Process

Bookings may be made by telephone or by other communication methods accepted by the Company from time to time. When making a booking, the Customer must provide accurate information, including:

Full name and contact details.

Collection address and any access instructions.

Type of waste to be collected, including any bulky items.

Approximate volume or quantity of waste.

Preferred collection date and time window.

The Company will provide an estimated price based on the information given. This price may be subject to adjustment if, upon arrival, the actual volume, weight or type of waste is different from that described at booking.

A booking is only confirmed when the Customer has accepted the quoted price and any applicable terms, and the Company has issued a booking confirmation. The Company may, at its discretion, require a deposit to secure a booking.

Access and Customer Responsibilities

The Customer is responsible for ensuring safe, reasonable and timely access to the Premises for the Company’s vehicles and operatives. This includes:

Ensuring that any necessary permissions are in place for access, loading or parking.

Providing clear instructions for locating the waste to be collected.

Ensuring that waste is ready for collection at the agreed time, unless an on-site loading service has been agreed.

Ensuring that the Premises are safe for the Company’s operatives to work at, including secure flooring, adequate lighting and unrestricted access routes.

If the Company is unable to carry out the Services due to a lack of access, unsafe conditions, or incorrect information given by the Customer, the Company may charge a call-out or wasted journey fee.

Waste Types and Compliance with Regulations

The Customer is responsible for accurately describing the type of waste to be collected. The Company collects general household waste, garden waste, commercial waste, bulky items and certain recyclable materials. The Company does not collect waste that is classified as hazardous or special waste unless this has been specifically agreed in writing in advance and is compliant with applicable regulations.

Prohibited or restricted items may include, but are not limited to:

Asbestos and materials containing asbestos.

Clinical or medical waste, syringes and pharmaceuticals.

Chemicals, solvents, oils, fuels and paint unless declared and accepted.

Gas cylinders, pressurised containers and explosives.

Radioactive materials or waste.

The Customer confirms that all waste presented for collection is owned by the Customer or that the Customer has full authority from the owner to arrange its removal. By presenting waste to the Company, the Customer warrants that it does not contain any prohibited items and complies with all relevant UK waste regulations, including the duty of care for waste producers.

Once the waste has been loaded into the Company’s vehicle, it becomes the property of the Company, and the Company assumes responsibility for transporting and disposing of it in accordance with applicable environmental legislation.

Waste Transfer Documentation

Where required by law, the Company will issue a waste transfer note or similar documentation evidencing the transfer of waste from the Customer to the Company and its subsequent management. The Customer must retain any waste transfer documentation provided for their records, in accordance with applicable regulations.

Pricing and Payment Terms

Prices are generally based on type and estimated volume of waste, loading time, access conditions and disposal costs. All prices will be quoted in pounds sterling and may be subject to VAT where applicable.

The Company reserves the right to adjust the final price if:

The actual volume or weight of waste exceeds the initial estimate.

The waste type differs from that described at the time of booking.

Additional labour, time or equipment is required to complete the job safely.

Unless otherwise agreed, payment is due immediately upon completion of the collection. The Company may accept payment by debit card, credit card, bank transfer or other methods that may be advised from time to time. For regular commercial Customers, invoicing terms may be agreed separately, subject to credit checks and approved account status.

Where payment terms are agreed on invoice, payment must be received within the timeframe specified on the invoice. The Company reserves the right to charge interest on overdue amounts at the statutory rate or any rate otherwise permitted by UK law, as well as reasonable costs incurred in collecting overdue payments.

Cancellations and Changes

The Customer may cancel or reschedule a booking by contacting the Company. The following provisions apply, unless otherwise specified at the time of booking:

Cancellations made more than 24 hours before the scheduled collection time will generally not incur a cancellation fee.

Cancellations made less than 24 hours before the scheduled collection time may incur a cancellation fee, which will be notified to the Customer.

If the Company arrives at the Premises at the agreed time and is unable to carry out the Services due to a reason within the Customer’s control, the Company may charge a wasted journey or minimum call-out fee.

The Company reserves the right to cancel or reschedule a booking due to circumstances beyond its control, including but not limited to severe weather, vehicle breakdown, staff illness, access issues or legal restrictions. In such cases, the Company will use reasonable efforts to inform the Customer as soon as practicable and to arrange an alternative collection time. The Company will not be liable for any loss arising from such cancellation or postponement, other than a refund of any pre-paid amounts for Services not performed.

Performance of Services

The Company will use reasonable care and skill in providing the Services. Collection times are given as estimates and time windows only, and are not guaranteed unless expressly agreed in writing as a timed service. The Customer acknowledges that traffic conditions, access issues and operational constraints may affect arrival times.

Operatives will load the agreed waste into the Company’s vehicle and may, where requested and feasible, assist with moving items from within the Premises to the collection point. The Customer is responsible for ensuring that any items to be removed are clearly identified and that no items intended to be retained are mistakenly presented as waste.

Customer Property and Site Condition

The Customer should take reasonable steps to protect driveways, surfaces and surrounding areas where loading will take place. While the Company will use reasonable care, heavy vehicles and equipment may cause wear or damage to surfaces not suitable for such use. The Customer acknowledges this risk where they direct the Company’s vehicles or equipment onto private property.

The Company is not responsible for normal wear and tear or minor cosmetic damage arising from the proper performance of the Services. Any significant damage alleged to have been caused by the Company’s negligence must be notified to the Company in writing as soon as reasonably possible and in any event within 7 days of the collection, including details and supporting evidence.

Liability and Limitations

Nothing in these Terms and Conditions limits or excludes the Company’s liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under UK law.

Subject to the preceding paragraph, the Company’s total liability to the Customer for any loss or damage arising out of or in connection with the Services, whether in contract, tort or otherwise, shall be limited to the price paid or payable for the specific collection giving rise to the claim.

The Company shall not be liable for:

Loss of profits, loss of business, loss of opportunity or any indirect or consequential loss.

Loss or damage resulting from inaccurate information supplied by the Customer.

Loss or damage arising where the Customer has failed to comply with these Terms and Conditions or applicable waste regulations.

The Customer is responsible for ensuring that any data, personal items or valuables are removed from items being collected as waste. The Company accepts no responsibility for any loss of data or personal items once the waste has been collected.

Customer Warranties and Indemnity

The Customer warrants that:

They are legally entitled to arrange the removal of the waste from the Premises.

The information provided at booking is accurate and complete.

All waste presented is lawful to collect, transport and dispose of, and does not contain any prohibited or hazardous items unless expressly agreed in writing.

The Customer agrees to indemnify and keep indemnified the Company against all claims, costs, penalties, liabilities, damages and expenses arising from any breach of these warranties or from any unlawful or unsafe waste presented for collection.

Data Protection and Privacy

The Company may collect and process personal data from the Customer, such as name, contact details and address, for the purposes of managing bookings, delivering the Services, processing payments and complying with legal obligations. Personal data will be handled in accordance with applicable UK data protection laws.

The Company may use Customer contact details to communicate about bookings, service updates and necessary information relating to waste collection services. Marketing communications will only be sent where permitted by law and the Customer may opt out at any time.

Complaints and Dispute Resolution

If the Customer is dissatisfied with any aspect of the Services, they should contact the Company as soon as possible, providing full details of the issue. The Company will investigate and respond in a timely manner, and may request further information or evidence to assist in resolving the matter.

The Company aims to resolve complaints amicably. If a dispute cannot be resolved directly, both parties agree to consider mediation or another form of alternative dispute resolution before commencing court proceedings, where this is practical and appropriate.

Amendments to Terms and Conditions

The Company may amend these Terms and Conditions from time to time to reflect changes in law, operational practices or business requirements. The updated version will apply to all new bookings made after the date the changes take effect. Significant changes will be brought to the attention of Customers where appropriate.

Severability

If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid or unenforceable, that provision shall be deemed deleted, and the remaining provisions shall continue in full force and effect.

Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services, including any non-contractual disputes or claims.

By confirming a booking or allowing waste to be collected, the Customer acknowledges that they have read, understood and agree to be bound by these Terms and Conditions.
